
Terms and Conditions
1. Definitions: “
the Agency” means J & G Services Ltd currently of 16 Devonshire
Street,
London W1G 7AF “
the Client” means the person(s), firm or other body corporate or unincorporated
having requested the use of the Agency’s services. “
the Applicant” means an individual or couple introduced by the Agency
for a permanent position whether full or part time.
2. Terms:
a) These terms and conditions constitute the contract between the Agency and
the Client and are deemed to be accepted by the Client by virtue of the interview
by the Client of the Applicant or the engagement of the Applicant by the
Client within six months of the date of introduction. The Client must notify
the Agency immediately an applicant is engaged.
b) No variation or alteration of these terms and conditions shall be binding
unless confirmed by the Agency. These terms and conditions are subject to the
laws of England and Wales.
3.The Client shall become liable to pay an introduction
fee to the Agency upon the engagement of the Applicant by the Client. The Client
will be invoiced
on commencement of employment.
4.The Agency’s fees are payable within
14 days of the invoice date and the Agency reserves the right to charge interest
on overdue payments at the
rate of 3 percent over base rate per month from the due date.
5.The fee payable
to the Agency for the introduction of the Applicant is charged in accordance
with our price list which may change from time to time without
notice.
6.The Agency offers a replacement within the guarantee period of 5 weeks.
This means that if the Applicant or the Client terminate the engagement with
just cause within 5 weeks of the start date, the Client must notify the Agency
immediately to enable a suitable replacement to be found.
7.The replacement
guarantee operates provided that:
a) the payment has been settled in full by the Client in accordance with the
Agency’s terms and conditions (see 4 above).
b) the Client or any subsidiary or associated Company of the Client does not
re-engage, use the services of, directly or indirectly, or refer the Applicant
for employment within twelve months of the termination of the engagement.
8.Should
a replacement not be found, the Agency will refund 75% of the fee paid by the
Client.
9. The Agency acts as an agent by introducing an Applicant to the Client
for an engagement. The Client shall be responsible for any relevant tax and/or
NI payments and the obtaining of any work permits that are required by law
and for the arrangement of any medical examination and/or investigation into
the medical history of the Applicant. The Applicant is the Client’s employee.

10. The Agency will endeavour to ensure but does not hereby guarantee the suitability
of any Applicant introduced to the Client. The Client should therefore satisfy
himself/herself as to his or her suitability, qualifications, capability and
integrity and take up any references before engaging the Applicant.
11. The Agency accepts no liability whatsoever for any loss, damage, costs,
claims or expenses, whether or not caused by negligence, made against or suffered
by the Client.
